General Terms and Conditions of Iglesias & Pereira Dona Mecia GbR

Iglesias & Pereira Dona Mecia GbR – hereinafter referred to as “Dona Mécia”
or “we” – is a company that offers pre-owned designer clothing and accessories from private previous ownership for sale. By placing an order, you agree to comply with and be legally bound by these General Terms and Conditions – hereinafter referred to as GTC.

Definitions:

The definitions listed below apply to our GTC:

  • “Order Date”: The date on which you placed the order to purchase an item.
  • “Purchased Item”: Any clothing, accessories, or other products acquired from us.
  • “Purchase Price”: The price displayed for the item, including statutory taxes.
  • “Content”: All photos, texts, or other information published by Dona Mécia on the Dona Mécia platform or Dona Mécia social media platforms.
  • “Customer”: Refers to the person who enters into a purchase contract with Dona Mécia.
  • “Delivery Fee”: The costs for the delivery of the item.
  • “Pre-owned”: The condition of the goods, indicating that they are used items from previous ownership.

Section 1: Ordering Information

Please place orders via our website. Your contract with Dona Mécia is concluded upon our order confirmation (acceptance of the offer). Since our goods consist predominantly of unique pieces, the conclusion of the contract is subject to the availability of the goods.

Section 2: Payment

Upon conclusion of the purchase contract, you authorize Dona Mécia to charge the payment method you have selected with the amount of the purchase price plus shipping costs. You confirm that you are authorized to dispose of the specified means of payment. The goods remain the property of Dona Mécia until full payment has been made (Retention of Title).

Section 3: Shipping and Delivery

  1. After completing your purchase on our website, you will receive a confirmation via email. We generally ship the goods within the periods specified in the shop.
  2. Shipping is always carried out as an insured package with tracking. The tracking number will be communicated to the customer via email after dispatch.
  3. The customer is obliged to ensure the accuracy and completeness of the delivery address. Costs for returns due to incorrect address data or failure to pick up the package at the post office branch shall be borne by the customer.
  4. For items with a high retail value, we reserve the right to carry out shipping using the services “In Person” or “Signature upon Delivery.”
  5. The risk of accidental loss or deterioration passes to the customer (or a recipient designated by them) upon handover of the goods by the shipping service provider, provided the customer is a consumer.

Section 4: Condition of Goods and Defects

  1. All goods offered by Dona Mécia are used (“pre-owned”) and are subject to general wear and tear (e.g., small marks, fabric pilling, or minimal hardware scratches on accessories). Minor signs of wear of this nature are considered the contractually agreed condition and do not constitute a defect.
  2. Color Representation: Dona Mécia endeavors to provide a true-to-life representation of the goods. Due to different screen settings and lighting conditions during photography, slight color deviations may occur; these do not constitute a material defect.
  3. Authenticity Guarantee: We guarantee the authenticity of all pieces offered. Should an item, contrary to expectations, prove to be non-authentic, this constitutes a significant defect entitling the customer to a reversal of the transaction.
  4. Notification of Defects: Should you find that an item has significant damage not mentioned in the description, please inform us immediately upon receipt of the order.
  5. Unauthorized Alterations: The warranty expires if the customer or a third party makes changes to the goods (e.g., shortening, tailoring, or unauthorized repair attempts).
  6. Warranty: For used goods, the warranty period is limited to one year from the delivery of the goods.

Section 5: Right of Withdrawal & Consequences

Right of Withdrawal: Since this is an online purchase, you as a consumer have the right to withdraw from
this contract within 14 days without giving reasons. The withdrawal period is 14 days from the day on which you or a third party named by you took possession of the goods. To exercise your right of withdrawal, you must inform us (Iglesias & Pereira Dona Mecia GbR, info@donamecia.com) by means of a clear statement of your decision. You may use the model withdrawal form provided on our website, but this is not mandatory.

Return of Goods: You must send the goods back to us immediately and in any event no later than 14 days from the day on which you inform us of the withdrawal. The deadline is met if you dispatch the goods before the 14-day period has expired. The direct costs of returning the goods shall be borne by the customer.

Right of Retention:
We may refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

Section 6: Return Conditions

In the event of a withdrawal, the goods must be returned unworn and in their original condition. This includes odor neutrality (free of perfume, sweat, or tobacco odors) as well as the absence of stains (especially makeup or deodorant residues).

  • Security Seal: Our goods are provided with a security seal. If this seal is removed or damaged, the goods are considered used. In this case, we reserve the right to claim compensation for the loss of value of the goods. (This also applies to the removal or damage of the sewn-in Dona Mécia label).
  • Completeness: The return must include all supplied accessories (e.g., designer hangers, dust bags, belts, authenticity cards, or original packaging), as these are essential components of the total value of the goods.

Section 7: Withdrawal by Dona Mécia (Non-availability)

Since our goods are curated unique pieces, the conclusion of the contract is subject to availability. Dona Mécia is entitled to withdraw from the contract if the goods were damaged before shipping, were lost, or are no longer available due to a stock error. In such a case, the customer will be informed immediately of the non-availability. Any payments already made (purchase price and shipping costs) will be fully refunded without delay. Further claims, in particular claims for damages, are excluded, unless Dona Mécia has acted with intent or gross negligence.

Section 8: Shipping Liability

Dona Mécia is not liable for delays caused by the shipping service provider (DHL). It is your responsibility to monitor the tracking. For items with a high retail
value, we use the “Signature upon Delivery” service for your protection and ours.

Section 9: Final Provisions

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Should individual provisions of these GTC be or become ineffective, the effectiveness of the remaining provisions remains unaffected.
