Iglesias & Pereira Dona Mecia GbR – hereinafter also referred to as “Dona Mécia” or “we” – is a company that offers sustainable designer clothing and accessories for rent. Dona Mecia is only available within the EU. By making a booking, you agree to comply with these General Terms and Conditions – hereinafter referred to as GTC – and to be legally bound by them.

Definitions:
The definitions listed below apply to our GTC:
• “Booking Date”: The date on which you placed the order for renting an item. This date is recorded in your contract.
• “Replacement Value”: The current market value of a clothing item or accessory from Dona Mécia.
• “Direct Debit Authorization”: The permission granted to us to collect amounts arising under the rental agreement by bank direct debit or PayPal from the bank account specified by you.
• “Fees”: ***********
• “Content”: All photos, texts, or other information published by Dona Mécia or members on the Dona Mecia platform or Dona Mecia social media platforms.
• “Deposit”: A security deposit set for a clothing item or accessory from Dona Mécia. This amount will be retained until the item is returned and confirmed to be in impeccable condition without damage.
• “Customer”: Refers to the person who enters into a rental agreement with Dona Mecia.
• “Clothing Item”: Any clothing or accessories rented from us. These are also referred to as rental items.
• “Delivery Fee”: The cost of delivering a rental item.
• “Rental Item”: Clothing, accessory, or other rental item.
• “Rental Fee”: The amount for renting an item.
• “Rental Period”: The agreed period during which the clothing item and/or accessory is rented by the customer.
• “Return Date”: The date by which the clothing item or accessory must either be dropped off at a post office (DHL) or returned to the pickup location.
• “Rental Start Date”: The date on which the rental period begins. This date is confirmed in your rental agreement.
• “Shipping Items”: Rental items that are rented and require a delivery service.

Section 1: Booking Information

Please make bookings for rental items via our website. Your contract with Dona Mecia is concluded upon our booking confirmation. If you need a rental item and the start date of your booking is within 72 hours (excluding weekends) from the time you make the booking on our website, you must expect not to receive a booking confirmation from us. In such cases, it is advisable to obtain approval from Dona Mécia before placing an order via our website at:

This is to ensure that your rental item is available for shipping and can be delivered on time.

Section 2: Payment and Confirmation
Upon conclusion of our rental agreement, you authorize Dona Mécia to execute the payment method selected by you for the scope you have booked. You confirm that you are authorized to make dispositions for the booked volume with the specified credit card/account. You further authorize Dona Mécia to use the payment method specified by you for additional amounts listed in these GTC (e.g., damages to clothing items or accessories or fees for late returns). If execution of the payment method specified by you is not possible, we will issue you an invoice, which must be paid within 5 working days. If your payment is reversed or declined for any reason, you are obliged to pay the outstanding amount within 48 hours of being requested to do so by Dona Mecia to our bank account. If the rental items have already been shipped, you are liable for the full amount.

Section 3: Booking Period
After completing your rental on our website, you will receive a booking confirmation from us by email. The rental start date is the day, your order is delivered by DHL. The rental period is "inclusive". For example, a 4-day rental period may mean that your order is delivered on Friday and you must return it on Monday. Both Friday and Monday are included in this example in the 4-day period. Postal delivery bookings: Your start and return date for the order must not fall on a Sunday, as, for example, Deutsche Post / DHL does not operate on Sundays.

Section 4: Incorrect or Faulty Rental Items
If you open your order and find that you have received the wrong rental item, please contact us immediately. In such a case, we will do our best to send you a replacement. If you find that a rental item has other issues (e.g., damage, visible stains), please also inform us immediately, at the latest within 24 hours of receiving the order and before using it. If you do not inform us within this timeframe, we reserve the right to reject a complaint, as it will not be clear when the damage occurred or who caused it. All clothing items and accessories owned by Dona Mécia are used for rental purposes and are subject to general wear and tear (e.g., small stains, marks, or fabric pilling). Minor such signs of use are considered insignificant.

Section 5: Issues with Fit or Appearance
What happens if the clothing item does not fit properly? Our fit policy takes this stress away from you. If the rental item does not fit, you will receive a credit minus a cancellation fee of €30.00 and the shipping costs. Important: The following steps must be followed on the day of receipt of your order to receive a credit:

1.    Contact us on the day of receipt of your rental item at info@donamecia.com or send us a direct message on Instagram at @donamecia.

2.    Place the order in the provided prepaid return bag and take the package to your local DHL branch. Take a photo of the deposit receipt. The order must be returned as soon as possible, at the latest on the working day after delivery.

3.    Once the unworn clothing item has arrived and been checked by us, we will issue a credit as described above. The credit is valid for 3 years.

Section 6: Cancellations by Customers and Refunds
• For cancellation requests received 1 month before the shipping date, you will receive a credit for the rental amount including shipping costs, minus a cancellation fee of €30.00. The credit is valid for 3 years.
• For cancellation requests received within 14 days before the shipping date, you are not entitled to a credit.
• In exceptional circumstances, we will be happy to consider a cancellation outside the above periods, but we reserve the right to decide on this.

Section 7: Cancellations by Dona Mecia
Dona Mecia may cancel your order in the event of loss or damage during a previous rental or for other reasons that preclude wearing the rental item. You will receive a refund of the amount you paid for the booking and shipping. However, Dona Mécia is not liable for any consequential damages that may arise from the cancellation. Reasons for cancellation by Dona Mécia may include:
• The rental item was damaged by a previous customer.
• The rental item was lost or stolen by a previous customer.
• It is not possible to deliver the rental item in time for your booking, e.g., due to a late return by a previous customer or impending delivery delays.

Section 8: Return of Rental Items
• Your order will be delivered to you with a prepaid DHL label for return shipping. This must be used for the return.
• Rental items must be dropped off at a DHL branch or depot on or before the return date specified in the rental agreement by 3:00 PM for return shipping. If the return date falls on a Sunday or public holiday, you can return the rental item on the following working day.
• If you lose the return label, you must obtain a new DHL label at your own expense. Please inform us immediately of the new tracking number.
• If a clothing item has become wet or damp for any reason, please contact us immediately. Wet or damp rental items may be damaged during shipping (e.g., mold formation). If the return is made in such a condition and the rental item is damaged, you are liable for the resulting damages.

Section 9: Cleaning
Cleaning is included in the rental price for all our clothing items. Cleaning is either hand washing or dry cleaning. We know that small accidents can happen and clean all clothing items at trusted cleaners as soon as we receive them back after the rental period. There are no additional costs for you. However, if stains require special cleaning, we will charge you the resulting costs. Please contact us immediately if a stain or damage (even a small one) has occurred to a clothing item, accessory, or other product. This allows us to plan accordingly and, if necessary, give you instructions if immediate cleaning is required. If you attempt to clean a rental item yourself or have it cleaned and cause damage or make a stain permanent, Dona Mecia reserves the right to charge you up to 200% of the purchase price of the rental item. The clothing items and accessories available on our website are sometimes sold out in retail and no longer available from designers. For this reason, replacement may be significantly above the RRP.

Section 10: Damage or Loss
If you damage a rental item, please do not attempt to repair it yourself. Minor repairs (e.g., sewing on a button or a seam) we will carry out at no additional cost to you. Please do not cut, alter, or stick anything on Dona Mécia rental items. This also applies to the label we have sewn into the garment, which must not be removed under any circumstances. If it is cut off, the dress will be considered damaged. If a rental item is damaged or lost, you are liable for the cost of restoration or replacement of the rental item. If the rental item cannot be restored to a reasonable condition, you must pay for the replacement of the item. This amount will be charged in addition to the rental and shipping costs already paid which may amount to up to 200% of the purchase price. If a rental item is lost during return shipping by DHL, you will not be charged any fees. Therefore, it is important that you personally drop off the rental item at a DHL branch and keep the proof of posting. This way, the rental item is scanned, and there is proof of posting in the tracking system.

Section 11: Late Returns
If you return the rental item after the agreed return date, late fees will be charged. The fee for each day exceeding the rental period is the duration of your order divided by the number of rental days. For example, if you chose a 4-day rental and the rental fee was €360.00, late fees of €90.00 per day would apply.

Section 12: Shipping
Dona Mécia is not liable for delays or damage to the rental item by DHL, as this is the responsibility of a third party. You will receive tracking updates from DHL by email and mobile number as soon as the rental item has been shipped. If you do not receive this information, please contact us immediately. It is your responsibility to monitor the shipment tracking and inform us if the rental item has not been delivered after the tracking information has been sent to you. If the rental item is marked by DHL as "delivered to a safe place" and the package cannot be found, please contact us immediately so that we can contact DHL and help you find the package. Dona Mécia will use the "Signature on Delivery" service for rental items with a high retail value (rental items worth more than €800.00). This additional service is included in the rental for the corresponding rental items. With the "Signature on Delivery" service, you must ensure that you can sign for the delivery or pick up the package at a DHL branch. This service is for the protection of the customer, Dona Mecia, and the rental item. You will be informed by tracking if your rental item includes this service.

Section 13: Natural Disasters and Force Majeure
If your event is affected by a natural disaster, a COVID-19 lockdown measure, official restrictions, or cases of force majeure, please immediately submit a cancellation request to Dona Mecia. If we receive a cancellation request before the rental item has been shipped, you will receive a voucher for the full rental amount. The voucher is valid for 3 years. If the rental item has already been shipped, we will only charge you the shipping costs (outbound and return shipping).

Section 14: International Travel
Our clothing items are only available for rent within the EU (Schengen Zone). If you wish to book a clothing item for a trip to a destination outside the Schengen Zone, you must contact Dona Mécia in advance and obtain approval for such a takeaway. If luggage is lost, you are liable for replacement value. For rental items used outside the Schengen Zone, Dona Mecia reserves the right to charge a reasonable deposit.
